Estate Administration

Estate administration is the process of handling a person’s legal, financial and tax affairs after their death. The process differs depending on whether the deceased left a valid Will, and our estate administration specialists are experienced in both dealing with testate estates (where a valid Will exists) and intestate estates (where either the deceased never made a Will, or their Will was not legally valid). Our specialises legal advisors will be able to gently guide you through every step of the process, providing you with clear and sympathetic advice throughout on matters including:-

  • Valuing the estate for inheritance tax purposes
  • Whether it is necessary to apply for a Grant of Representation and, if so, making the application on your behalf
  • Advising on the legal protection available to those responsible for dealing with the estate (known as the Personal Representatives). Often Personal Representatives do not appreciate the level of personal liability they are accepting when agreeing to deal with an estate and are not aware that, if something goes wrong, they could be liable to repay disadvantaged beneficiaries or creditors from their own personal funds. However protection is available to Personal Representatives to reduce the personal risks to them.
  • The payment of taxes including inheritance tax, income tax and capital gains tax
  • Tracing missing beneficiaries
  • Distributing the estate to the correct beneficiaries
